Legal advice regarding impotence of my brother's wife?

hello my name is sheela.i m writing on behalf of my brother.

My brother is Hindu married 2008.

his wife unable to consume marriage with him.

i want know how does court prove non consumation of marriage and impotency.

1. what is the name of medical tests to prove impotency in a female?

2. Can court also order medical tests to know if marriage is consumed?
becoz according to my brother she did not have hymen during marriage.so she may lie that it was consumed.

my brother wants to get her tested now before giving an application for same in court so that he is sure of above facts,to avoid any embarassment if proven wrong in court.

If there are conflicts, just have your brother divorce the poor girl! Why dragging her into all these proving? What are you trying to prove?

Women CAN'T be impotent. Only men can be. That is simple biology.

If he's never had sex with her, then how does he know she didn't have a hymen? Is he a doctor? If so, then that should have been brought to the courts IMMEDIATELY. Not having one isn't a thing you can be divorced for in the U.S., so I'm guessing they aren't in this country?

Just because the hymen isn't there, DOESN'T mean she wasn't a virgin for marriage. A hymen can break by means of certain injuries, none of which is sexual in nature.

If he has that many doubts, let him handle everything privately, and just divorce her. There is no trust there, and he obviously doesn't love her. If he did, these issues wouldn't even come up.

You are saying that your sister-in-law is not a Virgin? Which has nothing to do with impotency - she probably does not want to be with your brother esp. if she was forced to marry him and her lack of having sex with him is not desired by her - which in some cultures are practiced and very unfair to young girls and women.

If your sister-in-law will not have sex with your brother - he does not need proof - he can divorce her and sadly you should not be involved - but that is another story!

Impotence is when a man is unable to acheive an erection...since women do not have a penis, they can NOT suffer from impotence.

The only 'test' that can be done is to determine if a woman is fertile or not....do not asume she isn't....HE may be the infertile one.

If your brother never consumated his marriage, then how would he know is wife lacks a hymen. And why hasn't he consumated the marriage-is she refusing sexual intercourse or is he unable to penetrate-if that is the problem it may be due to a very tough hymen and a doctor can fix that.

All a physical exam would prove is if she has or had a hymen, and if she ever had a baby, however, MANY virgins DON'T have one from physical sports such as horse back riding, tampon use, and many girl babies are born without one, too. Many virgins do NOT bleed after the first time so one can not go with that, either.

Now if she is now refusing to sleep with him , that is called Abandoment of the Marriage here in the USA.

So you need to be clear on EXACTLY what the issue is and understand this, if by impotence you mean she is not interested in sex or gets no pleasure from it, that is not impotence and there is no 'test' for that either unless she discusses it with a psychiatrist.

...and in the USA a woman can NOT be ordered to under go an internal examination of her privates by any judge as that is an invasion of her body, no judge or court has the right to force an invasive medical exam or treatement on a US citizen.

A female cannot be impotent. Perhaps your brother is impotent.

Absence of hymen means nothing.
